Two local lawyers are taking on the cause of MyCaregiver medicinal marijuana cooperative in Monterey. Richard Rosen and Jeanine Strong say they will not only prove the nonprofit co-op is operating legally, but will go after the “real violators” — local governments and law enforcement agencies that have refused to implement the medicinal marijuana law. In the 14 years since the Compassionate Care Act legalized medicinal marijuana in the state, Rosen told the Monterey County Herald, not one medical marijuana facility has been authorized in the county. “While the rest of the state is following [...]
Monterey city officials are seeking a permanent court order to shut down a medical marijuana dispensary that opened last year on Lighthouse Avenue, the Monterey County Herald reports. A temporary order was issued in March by Monterey County Superior Court Judge Robert O’Farrell, in favor of the city, requiring MyCaregiver Inc. to close after the city sued. But the dispensary has continued to operate in violation of the order, according to court papers filed by the city attorney’s office Thursday. Jhonrico Carrnshimba, who is named as a defendant, has said that MyCaregiver is a nonprofit [...]
The group that opened a medical marijuana dispensary on Lighthouse Avenue in Monterey will keep its center open as a meeting place for current members of their cooperative, the Monterey County Herald reports. A member who answered the door Thursday, who identified himself only as Marc, said the court order issued March 12 against the cooperative, MyCaregiver Inc., prohibits only operation of a medical marijuana dispensary at the location. “We are here and we are open to existing members,” he said. Members can go to the center to congregate and “then do whatever it is [...]
A Monterey medical marijuana dispensary has been ordered by the court to close immediately, city officials said Friday. Superior Court Judge Robert O’Farrell issued a preliminary injunction in favor of the city, requiring MyCaregiver Inc. at 554 Lighthouse Ave. to shut down, said Assistant Monterey City Attorney Christine Davi. Davi said the order would be finalized once signed by O’Farrell, which she expected to judge would do Friday, the Monterey County Herald reports. O’Farrell’s ruling came after hearing arguments from Davi and MyCaregiver’s attorney, Jim Roberts of San Jose. The judge found that MyCaregiver opened [...]
Monterey has sued the proprietor of a medical marijuana dispensary alleging that the business violated the city’s zoning codes by setting up shop in town last fall. City officials filed the complaint against MyCaregiver Inc. and director Jhonrico Carrnshimba on Monday, after the City Council voted 4-1 in closed session Feb. 2 to authorize legal action against the clinic, which has been operating at 554 Lighthouse Ave. since November. Also Feb. 2, the council finalized a 45-day moratorium on medical marijuana clinics, initiated under an emergency ordinance. Council member Jeff Haferman dissented, the Monterey County [...]
Monterey County sheriff’s deputies today reported seizing more than 300 marijuana plants from an indoor growing operation at a house in Prunedale. The discovery was made Tuesday after deputies said they learned about the operation at a Chester Drive home and a search warrant was issued. It is the third indoor marijuana operation discovered in Prunedale in the past month, the Monterey County Herald reports here. The 303 marijuana plants seized Tuesday were growing in various stages in what deputies described as a sophisticated hydroponic system. The electricity meter to the home was bypassed, deputies [...]
As the Monterey County Herald reports here, the Monterey City Council is set to consider a 45-day moratorium on medical marijuana dispensaries at its Tuesday meeting. The Herald’s Daniel Lopez offers a more in-depth story on the subject than average, with contributions by fellow reporter Kevin Howe. ================== The proposed moratorium was spurred by the opening of MyCaregiver Inc. on Lighthouse Avenue. (The hyperlinked City Council agenda is here.) City officials say MyCaregiver is a medical marijuana dispensary and the nature of the business was not fully disclosed when a business license was applied for. [...]
This Monterey County Herald editorial is evidence that newspapers can and do speak up as institutionalized voices of reason. The writer’s gentle pot humor helps deliver the message that some questions are worth pondering. ============= If we’re going to legalize marijuana — and it appears that we will, sooner rather than later — we all might want to make like pot smokers and ponder the ramifications at considerable length before it comes to pass. As with most things, legalization of marijuana is not as simple as it might seem. Changing the law itself may take [...]
