Alta Sierra neighbors have complained for weeks about a large marijuana garden on an Annie Drive vacant lot, less than a half-mile from the local elementary school. The garden has become a catalyst for a new community group pushing for a county-wide ordinance to restrict or ban marijuana growing in residential neighborhoods. The ordinance, being developed by Nevada County Counsel Michael Jamison, has drawn the support of Supervisor Ed Scofield, who represents Alta Sierra. “It’s frustrating because there is no regulation,” Scofield said of those growing marijuana with medical prescriptions. “It’s not so much the [...]

Sacramento District Attorney Jan Scully will not file charges in Isleton’s aborted plans for a large medical marijuana farm, but she made it clear that she believes the whole matter was bungled from the start. “Had the marijuana cultivation farm project become operational it would have been illegal under state and federal laws and not in compliance with attorney general guidelines,” Scully’s office wrote in a scathing 21-page report released Thursday. The report is the latest swipe at the Delta town’s failed efforts to generate revenues by approving a 15,000-square-foot farm on the northern edge [...]

Two Sonoma County lawyers behind a new statewide effort to legalize marijuana believe 2012 could be their year. Joe Rogoway and Omar Figueroa have drafted a ballot initiative that would repeal all laws against possessing pot, allowing anyone 18 or older to have up to three pounds and to maintain a 100-square-foot garden. The state Department of Public Health would oversee regulation and taxation of commercial sales, Paul Payne reports in the Santa Rosa Press Democrat. The measure could go before voters at the November presidential election when turnout is expected to be larger and [...]

A Mountain Gate man going through a “bad trip” on methamphetamine imagined someone was sneaking onto his marijuana grow, so he started shooting early this morning in the same home where his two young children were, sheriff’s investigators allege. Brian Anthony Walker, 33, didn’t hurt anyone when he began firing about 5:25 a.m., though his family and the two men who were camped outside guarding the grow were extremely fortunate they weren’t shot, Shasta County sheriff’s Sgt. Steve Grashoff said. The shooting, which led to a standoff with the Shasta County Sheriff’s SWAT Team that [...]

Kern County Superior Court Judge David Lampe played his cards close to the vest Friday as lawyers for medical marijuana collectives and the county of Kern tried to sway him to their side of the debate over the county’s 12-plant limit on medical pot cultivation. He didn’t issue a tentative ruling or speak about which way he planned to rule, James Burger reports in the Bakersfield Californian. Lampe heard arguments from Chief Deputy County Counsel Mark Nations and medical marijuana collective attorney Phil Ganong and told them his ruling on a preliminary injunction would be [...]

The Mendocino County Board of Supervisors will consider a moratorium on medical marijuana dispensaries that would last until burgeoning regulations for the dispensaries are in place, Tiffany Revelle reports in the Ukiah Daily Journal. The item wasn’t on the board’s agenda, but 1st District Supervisor Carre Brown suggested putting the discussion on the board’s Sept. 20 meeting agenda after 18 people voiced strong opposition to a dispensary proposed in downtown Boonville. “It’s a sacrilege to even consider having a dispensary in our community, and I think it’s a disgrace,” Boonville resident Donna Reily said, noting [...]

A Guatemalan man is scheduled to take the stand in Humboldt County Superior Court today to testify against the man who allegedly shot him in the face and back last year after a dispute at a marijuana grow operation near Kneeland. Mikal Xylon Wilde, 29, of Eureka, has pleaded not guilty to charges of murder, attempted murder and cultivation and possession of marijuana for sale. A preliminary hearing this week will culminate with a judge determining whether there is enough evidence to hold Wilde to stand trial, Thadeus Greenson reports in the Eureka Times-Standard.
