RED BLUFF – The short history of the city’s only medical marijuana collective ended this week with the sentencing of a mother-daughter team that operated Blue Toad Inc.

Lana Aguiar and Ashley Arnold were each fined $90 in Tehama County Superior Court on misdemeanor violations of land use and occupancy ordinances, a court clerk said. They were found guilty after a court trial Wednesday before Judge John Garaventa, the Redding Record-Searchlight’s Janet O’Neill reports.

The charges stem from citations issued Nov. 3 at the shop’s Hickory Street location, said Red Bluff police Detective Kevin Hale. As part of the sentence, the pair must refrain from violating the law for 12 months or each face an $830 penalty, the court clerk said.

The collective opened Oct. 13 and closed Nov. 4, the day after the City Council adopted an “urgency” ordinance banning dispensaries in the city. Arnold has said she and her mother shut down the collective to avoid repercussions for the landlord.

In January, Garaventa upheld $920 in fines and court fees for each of the women based on citations issued in October, Police Chief Paul Nanfito said at the time.

The council in December extended its dispensary moratorium through October to give the city time to develop regulations.

Meanwhile, the Tehama County Board of Supervisors last month released a draft ordinance covering medical marijuana cultivation in the unincorporated areas of the county. Supervisors could consider the proposed law as soon as next week.

The county also has a temporary dispensary ban in place.

Dawn and Mike Jenkins, former operators of the Red Bluff Patient Collective, face misdemeanor charges based on alleged violations of the county’s moratorium and zoning rules. Sheriff Clay Parker, whose office is next door to the now closed shop, issued citations to the pair over 35 days last year.

A pretrial conference is scheduled for June 23.
